Jeanette Gibson New Media Art: High-Resolution Digital Editions – Terms and Conditions for Individual Use License

These Terms and Conditions (“Terms”) govern your acquisition of a high-resolution digital edition of New Media Art created by Jeanette Gibson (“Artwork”) under an individual use license. By making an offer and subsequently acquiring an Artwork, you agree to be bound by these Terms.

1. License Grant

Upon successful acquisition of an Artwork, Jeanette Gibson grants you a non-exclusive, non-transferable, revocable, worldwide license to use the high-resolution digital file of the Artwork solely for personal, non-commercial purposes (“Individual Use License”).

2. Permitted Uses

Under this Individual Use License, you may:

  • Display the Artwork on personal electronic devices (e.g., computers, tablets, mobile phones, digital frames) for your private enjoyment.
  • Print the Artwork for your personal display in a private residence or office, provided the print is not resold or publicly displayed.
  • Use the Artwork as a desktop background or screensaver on your personal devices.
  • Share the Artwork with a limited number of individuals (e.g., family and close friends) for their personal viewing, provided no commercial gain is derived and the sharing does not enable further distribution or public display.
3. Prohibited Uses

Under this Individual Use License, you may not:

  • Resell, sublicense, redistribute, or commercially exploit the Artwork in any form, including but not limited to selling prints, digital copies, or derivative works.
  • Publicly display the Artwork in any commercial establishment, gallery, exhibition, or public forum (including online platforms with public access) without obtaining a separate commercial license.
  • Modify, adapt, or create derivative works based on the Artwork.
  • Use the Artwork for any promotional, advertising, or marketing purposes, whether for yourself or a third party.
  • Claim authorship or ownership of the Artwork.
  • Use the Artwork in a manner that is defamatory, obscene, or infringing of any third-party rights.
4. Ownership and Intellectual Property

Jeanette Gibson retains all right, title, and interest in and to the Artwork, including all copyrights and other intellectual property rights. The Individual Use License granted herein does not transfer ownership of the Artwork to you.

5. Making an Offer and Acquisition
  • Offer Process: The Artwork is available for acquisition by making an offer. Jeanette Gibson reserves the right to accept or reject any offer at her sole discretion.
  • Payment: If your offer is accepted, you agree to complete the payment as specified during the offer process.
  • Delivery: Upon successful payment, the high-resolution digital file of the Artwork will be delivered to you via a secure method.
6. Disclaimer of Warranties

The Artwork is provided “as is,” without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. Jeanette Gibson does not warrant that the Artwork will meet your specific requirements or that its operation will be error-free.

7. Limitation of Liability

In no event shall Jeanette Gibson be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Artwork, even if advised of the possibility of such damages. Your sole remedy for any dissatisfaction with the Artwork is to cease using it.

8. Termination

Jeanette Gibson reserves the right to terminate this Individual Use License immediately if you breach any of these Terms. Upon termination, you must immediately delete all copies of the Artwork from your devices and destroy any printed copies.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.

10. Entire Agreement

These Terms constitute the entire agreement between you and Jeanette Gibson regarding your acquisition and use of the Artwork under an Individual Use License, superseding all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.

11. Amendments

Jeanette Gibson reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on the relevant platform. Your continued use of the Artwork after such modifications constitutes your acceptance of the revised Terms.


By proceeding with an offer for a Jeanette Gibson New Media Art High-Resolution Digital Edition, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
